ALBANY, NEW YORK, UNITED STATES, November 17, 2017 /EINPresswire.com/ -- There was overwhelming evidence produced in this trial that still reveals many of the same systemic failures dating back to Willowbrook. Most of the facts and testimony that have allowed countless innocent and extremely vulnerable people with disabilities to be; sexually abused, severely harmed, or die prematurely as well as these crimes to be internally covered-up, were suspiciously blocked from coming into this federal trial.

Direct evidence that Governor Cuomo personally ordered the promotion of Jeff Monsour out of the hostile OPWDD work environment for his whistle-blowing activities to protect the disabled was kept from the jury. An expert on Cuomo’s system and the scope of abuse and neglect, as well as on the wide-scale cover-ups, Michael Carey personally requested Governor Cuomo to promote Mr. Monsour for his heroic actions and was in the room with the governor when he ordered it. It turned out that Governor Cuomo was playing some kind of sick game and lied, allowing Mr. Monsour to suffer for many more years for simply doing his job, which is to care for people with disabilities. As the founder of Jonathan Carey Foundation and the parent of a 13 year old child named Jonathan who was killed in State care in 2007, I am outraged at the further injustices I have witnessed. I was personally blocked from being able to testify in this extremely important federal court case that can affect upwards of 1,000,000 lives. I am exercising my first amendment right of free speech to bring some key facts specifically surrounding direct causes that allow the rampant sexual abuse, rapes of girls and boys, as well adults of people with developmental disabilities within OPWDD, who is being sued and a defendant in this case, to continue and to be covered-up;

• Incompetent and gross insufficient employment and criminal background checks

• Direct care workers for the disabled do not need to be significantly trained or licensed, yet hair dressers and massage therapists do, among many other fields of employment

• No surveillance cameras in facilities or transport vehicles to help prevent these sex crimes or provide evidence to such heinous crimes to hold sexual predators accountable

• Darkened windows in most transport vehicles for the disabled

• Male staff alone bathing and doing women’s personal hygiene on their private areas, this is a recipe for sexual abuse and rape

• Male staff alone transporting disabled girls and women in many cases that are non verbal in vans with darkened windows and no surveillance cameras, again a recipe for sexual abuse and rape

• Unsafe staffing levels, in many cases only one or two on overnight shifts. A convicted sexual predator said Cuomo’s system is “a predator’s dream.

• Hardly any direct oversight of staff or any independent oversight of facilities, Cuomo’s system is likened to an animal house, where virtually anything goes.

• Staggering numbers of sexual assaults and rapes of the disabled and those struggling with mental illness are ordered by the governor to be internally reported to another State agency under his control, instead of 911, so almost all are covered-up with the governor’s knowledge and involvement.

• The disabled are denied their most basic equal rights to 911 emergency services and equal protection of laws when they are victims of sexual assault crimes while living in residential facilities and group homes. The disabled are being discriminated against and treated as a sub-human class of human being.

• The end result of such gross negligence and corruption is that tens of thousands of extremely vulnerable children and adults with disabilities are being used for sex and severely damaged within Cuomo’s mental health agencies every year.

Sexual abuse, rapes and cover-ups are crimes. Sexual abuse, rapes and cover-ups is the culture within Governor Andrew Cuomo’s OPWDD agency being sued in federal court. Here is the scope of this evil and criminal enterprise that is deeply rooted in Medicaid fraud. Governor Cuomo and the State of New York have done everything imaginable to conceal and hide this damning information from the feds;

“New York State documents obtained through Freedom of Information Law (FOIL) dating back to 2005 reveal that the New York State OMRDD/OPWDD system has a culture of sexual abuse, rape and cover-ups. Thousands of reported sex crimes committed against the disabled are never reported to local police or District Attorney’s and are disappearing within the system that former Attorney General Cuomo and now Governor Cuomo has protected with a vengeance http://www.einpresswire.com/article/414428414/cuomo-has-been-protecting-sexual-predators-for-over-a-decade?n=2 . State data, as well as this well known study found on the State of Massachusetts website titled, Prevalence of Violence, http://www.mass.gov/dppc/abuse-recognize/prevalence-of-violence.html point to possibly one third of developmentally disabled residents within Governor Cuomo’s OPWDD system are being sexually assaulted annually. In the OPWDD system of 126,000 developmentally disabled children and adults, many of whom cannot speak to tell anyone anything, there are upwards of 43,000 victims of sexual assaults or rape every year. In March of 2011 the first of a massive series of investigative reports done by the New York Times came out regarding New York’s extremely dangerous and deadly mental health care system http://www.nytimes.com/2011/03/13/nyregion/13homes.html . Jeffrey Monsour is featured in this report along with Michael Carey, and this massive award winning series was a runner up for a Pulitzer Prize http://www.nytimes.com/interactive/nyregion/abused-and-used-series-page.html . The person mentioned in the first piece regarding sexual abuse, is Rick Sousie, this is what the times wrote;

“Five years ago, Mr. Sousie, then 47, was working at the home in Hudson Falls, about 50 miles north of Albany. After a co-worker saw him alone and standing between the legs of the severely disabled woman, who was lying on her back, the police were alerted. The victim was taken to the hospital, where a rape kit was administered, and Mr. Sousie was placed on administrative leave.”

Some paragraphs later, his disturbing defense claim, “Mr. Sousie, in an interview, denied that he had been involved in a sexual assault.”

“I was tucking in my shirt, and I got accused of raping a client, that’s what happened,“ he said. When it was pointed out that his lawyer had, as a defense, argued that Mr. Sousie had been masturbating — hence the presence of physical evidence — he conceded, “That’s the defense that we used, yes,” but declined to elaborate.

The general public needs to know the truth that this portion of this New York Times "Abused and Used" investigative news report was directed to be redacted in this whistle-blower retaliation lawsuit. Simply put two and two together, Governor Cuomo is being attempted to be protected. The truth must be made known, for over a decade both Jeffrey Monsour and Michael Carey have brought many of these systemic failures and the corruption to the Governor’s attention dating back to when he was the New York State Attorney General.

“There is much the governor could do. He could require surveillance cameras in these facilities, just as prisons have them. He could make sure that the police get more involved.”

So why would Governor Cuomo practically ignore everyone? Governor Cuomo ignored well known advocates and whistle-blowers Michael Carey and Jeff Monsour, but more importantly he ignored the safety, health, equal rights and lives of 1,000,000 New Yorkers with disabilities and their families. Governor Cuomo ignored the New York Times investigative reporting series and took no decisive actions to stop or prevent the rampant sexual abuse, rapes or cover-ups. Governor Cuomo has ignored and violated his oath of office to the Constitution and has blatantly denied people with disabilities equal access to 911 call systems and emergency medical and police services and assistance, as well as denied 1,000,000 New Yorkers with disabilities their equal rights to equal protection of laws.

Governor Cuomo knows about these atrocities, he has protected most of the sexual predators and criminals involved and he has taken no significant actions to stop or prevent any of these sex crimes or criminal cover-ups. Governor Cuomo must be investigated and criminally charged as soon as possible.
